I know I haven’t posted in donkeys, but so much has been going on. Especially something serious.
I filed for a trademark earlier this year for my name and logo banner. Then last week I received a letter from patent and trademark attorneys informing me that my trademark was being opposed by a large overseas corporation that carried on under a particular name here in Australia.
A long list of oppositions followed, some claiming I am not Australian, the lady who issued my trademark didn’t know what she was doing, I filed my trademark in bad faith, ammended it after the issue date, that the people at large would not be able to distinguish between our names and logos, that the whole world would be confused, and how dare I use their name in mine!!!!
Besides being overly dramatic, they’re assuming idiotic things when they haven’t bothered finding out the truth.
Yes, I have a few hearts in my logo, and my name is partly in pink, but so what!!! I don’t have ”THEIR” name in mine and I have an extra word in front of it, and a ”s” after it. I also have three girls standing in front of a diamond. Something they definitely DON’T have.
I’m also a little online shop, not a massive chain store conglommerate that’s going to take over the shopping centres and malls of the world. There’s plenty of other chain stores to do that. Besides, they buy in mass bulk from China, I handmake my stuff right here in Australia.
I love this particular chain store and buy from them often. I’m even registered on their website to receive newsletters, but now, I’m very unsure about continuing to give them my money. But then what would they care, I’m just one person in a sea of millions!!!
So why don’t you all tell me whether or not you can distinguish between our logos and names!
Obviously, there is nothing alike with the banner, the logo and the name! Startign with the typo, first!!! But trademark and branding is a serious biz… Some will freak out at the smallest of things just to have the exclusivity. It’s very stupid.
I hope they’ll leave you alone!

They are a bit pedantic over the silliest of things. It’s all a bit stupid really.
Ugh – what a headache and a heartache. Keep digging your heels in them and don’t give up!!
